LEGAL & COMMERCIAL IN-HOUSE ATTORNEY

Introduction

The Legal & Commercial in house attorney is responsible for managing the full contract lifecycle across the Group, ensuring legal compliance, commercial protection, effective risk mitigation, and sound contractual governance.

The role provides legal and commercial support throughout the tendering, negotiation, project execution, and contract close-out phases while serving as the custodian of all contractual documentation and processes.

Duties & Responsibilities

Contract & Commercial Management

• Draft, review, negotiate, and administer a wide range of commercial contracts, including customer, supplier, subcontractor, SLA, NDA, MOU, lease, and service agreements.
• Maintain and manage the Group's contract and document control systems.
• Support business units in contract negotiations and commercial decision-making.
• Ensure contractual compliance with company policies, legislative requirements, and governance standards.

Project & Construction Contract Support

• Review and advise on construction and project contracts, including FIDIC, JBCC, NEC, GCC, SCC, and other industry-standard forms.
• Monitor project contract compliance and contractual obligations throughout the project lifecycle.

Stakeholder Management

• Act as the primary legal and commercial contract advisor to internal stakeholders.
• Partner with Executive Management, Sales, Procurement, Finance, Operations, HR, Clients, Suppliers, and external advisors to ensure effective contract governance and risk management.

Desired Experience & Qualification

Qualifications

• LLB, BCom Law.
• Admitted Attorney advantageous.
• Postgraduate qualification in Commercial Law, Construction Law, or Contract Management advantageous.

Experience

• Minimum 10 years' experience in legal and commercial contract management.
• Experience within manufacturing, construction, engineering, infrastructure, or project-based environments.
• Strong working knowledge of FIDIC, JBCC, NEC, GCC, SCC, and other standard forms of contract.
• Proven experience in contract negotiation, contract administration, claims management, and dispute resolution.

• South African Contract, Commercial, and Corporate Law.
• Construction and engineering contract management.
• Procurement and supply chain contracts.
• Contractual risk management and corporate governance.
• Incoterms, foreign exchange considerations, and international trade requirements.
• Strong negotiation, analytical, communication, and stakeholder management skills.
